French-American Chamber Of Commerce In The United States, Inc.-New York Chapter (“we”, “us” or “FACCNY”) has created this privacy policy statement (the “Privacy Policy”) in order to demonstrate our commitment to your privacy. The following describes how we collect, use, and disclose your personal information when you visit our site (https:// www.faccnyc.org/) (the “Site”), become a member and use our services or otherwise communicate with us (collectively, the “Services”).  For the purposes of this Privacy Policy, “you” and “your” mean you as the user of the Service, whether you are a customer, website visitor, or another individual whose information we have collected pursuant to this Privacy Policy.

We may collect personal information about you on our Site in the following ways:

Information You Provide:  When using the Site, or in order to utilize some of our Services, you may choose to upload, or we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you (“Personal Information”). • Passport Number (collected only when necessary for specific services requiring identity verification)

• “Usage Data,” which is data collected automatically, generated by either the use of the Site or from the Site infrastructure itself (for example, the duration of a page visit). 

We collect Personal Information from you when you choose to participate in our offers and programs or when you otherwise provide information directly to us, including when you subscribe to a membership with the FACCNY, use our service, participate in our interactive features or otherwise interact with us on the Site. 

Information We Collect Automatically: We may automatically collect Personal Information about you, such as site usage information, information about your computer or mobile device, when you access our Site. For example, we may log your computer or mobile device operating system, manufacturer and model, browser type, browser language, the website you visited before browsing to our Site, pages you viewed, how long you spent on a page, and information about your use of, and actions on, our Site. We collect this information about you using cookies. Please refer to the section “Cookies” below for more details.

Information We Obtain from Social Networking Sites: We may maintain pages on Social Networking Sites (each a “SNS”), such as Facebook, LinkedIn, Twitter, Google, and other third-party platforms. When you visit or interact with our pages on those platforms, the platform provider’s Privacy Policy applies.

Information We Obtain from Third Parties: We may receive information about you from third-party sources, such as marketing partners, publicly available sources, and data service providers, and we may add this to the information we get from our Site.

2. How We Use Personal Information: 

To Provide Services:  We may use your Personal Information to:

• Process, deliver and fulfill any FACCNY Services;
• contact you about our Services;
• personalize your experience with us including by presenting our services and offers tailored to you, and;
• allow you to use, communicate and interact with us on our Site.

To Publish Select Membership Directories. We may use your Personal Information to publish select membership directories, membership lists and registration lists on the Site and in print and digital media (e.g. Committee and Board rosters and online communities), subject to your prior opt-in consent for public directory listings. Such directories and lists will not include credit card information, social security numbers, passport numbers, or other sensitive personal information numbers, as set forth in the contact information at the bottom of this webpage.

To Send You Marketing and Promotional Communications:  We may send you marketing communications, as permitted by applicable law, with your prior consent where required. You will have the ability to opt out of our marketing and promotional communications at any time as described in the Opt-Out of Marketing section, below.

To create anonymous, aggregated or de-identified Information:  We may aggregate Personal Information so that the aggregated information does not personally identify you or anyone else, such as by using Personal Information to calculate the percentage of our customers who live in a particular area (“Aggregate Information”). In some instances, we may combine Non-Personal Information with Personal Information. If we combine any Non-Personal Information with Personal Information, the combined information will be treated by us as Personal Information.

To conduct our business securely and protect our activities and personnel. To deliver our services safely to you, perform our contract properly or comply with some of our legal obligations, we will implement fraud prevention and detection measures. Such measures will allow us to adequately perform our contract with you and/or protect our legitimate interests in defending ourselves against fraud. We may notably implement measures to ensure that you are complying with our terms and conditions of services, available on this website, offers and programs, and to prevent and detect non-compliance or fraud by you. This may include reviewing and assessing your dealings with us, your eligibility to participate in certain sales, offers and programs, your compliance with the terms and conditions of such sales, offers and programs, and undertaking enforcement action and/or disciplinary action where such non-compliance or fraud is suspected or identified.

To allow our users to interact on SNS: Our Site contains social buttons so-called widgets depicting the icons of SNS (e.g., LinkedIn and Instagram), which allow users to reach and interact directly on the member or Company’s corporate page on SNS with one click. When the user is on the SNS, the latter acts as data controller and defines the management and processing of user’s personal data in total autonomy. Information on the social SNS’ processing of personal data is available on the social SNS’ website.

To provide your employment information: In connection with the employment service available on the Site, you will be given the opportunity to provide additional information either (i) about yourself such as your skills, experience, education level, and job requirements, or (ii) about the position(s) you seek to fill, such as the sector, job requirements and qualifications. If you submit a resume and other information about yourself in search of employment, an anonymous summary of this information will be accessible to FACCNY Members who are employers potentially interested in hiring you, subject to your explicit consent. Information about job opportunities will be accessible by all FACCNY Members and individuals who have registered for FACCNY’s employment service via the Site. We may also use this information in aggregated form to provide FACCNY Members with statistical information about the overall community of FACCNY Members.

3. How We Share Your Personal Information:

We may share your Personal Information with third parties in the following circumstances:

• Affiliates. We may disclose your Personal Information to our subsidiaries and corporate affiliates for purposes consistent with this Privacy Policy.
• Service Providers. We may share your Personal Information with third-party companies and individuals that provide services on our behalf (such as payment processing, hosting, analytics, email delivery, marketing, and database management services). These third parties are contractually obligated to use Personal Information only as directed by us, maintain appropriate security measures, and process data in a manner consistent with this Privacy Policy and applicable law.
• Business Partners. We may share some of your Personal Information with our third-party business partners such as mailing and delivery services companies and event registration services companies, as necessary to provide services you have requested. These third parties are contractually obligated to use Personal Information only as directed by us and to maintain appropriate security and confidentiality measures.
• Social Networking Sites. For advertising purposes, we may identify you on our SNS in a post or story if you used FACCNY’s Services or participated in a FACCNY event, subject to your prior consent or unless you have opted out of such identification.
• Professional advisors. We may disclose your Personal Information to professional advisors, such as lawyers, auditors and insurers, where necessary in the course of the professional services that they render to us.
• Compliance with Laws and Law Enforcement. Protection and Safety. We may disclose information about you to government or law enforcement officials or private parties as required by law, and disclose and use such information as we believe necessary or appropriate to (a) comply with applicable laws and lawful requests, such as to respond to requests from government authorities; (b) enforce the terms and conditions that govern use of the Sites; (c) protect the rights, privacy, safety or property of users of our Sites and (d) protect, investigate and deter against fraudulent, harmful, unauthorized, unethical or illegal activity.
• Business Transfers. We may sell, transfer or otherwise share some or all of our business or assets, including your Personal Information, in connection with a business transaction (or potential business transaction) such as a merger, consolidation, acquisition, reorganization or sale of assets or in the event of bankruptcy, in which case we will make reasonable efforts to require the recipient to honor this Privacy Policy.

4. Data Retention Period:

Data collected for the purposes outlined in section 1 will be retained for the time period necessary for which it was collected, for any subsequent purpose that is compatible with the original purpose, or as required by applicable law. We will keep prospective members/users information that we use for prospection purposes for no more than 3 years starting from the date of the last interaction with the prospect members or user of our Service. We refrain from keeping data collected through cookies and other trackers for more than 13 months without renewing our notice and obtaining your consent as the case may be.  This does not affect your right to revoke your consent before the end of its retention period. When said consent is revoked or if the time limit for the retention of data collected expires earlier, the data will be automatically erased or made permanently anonymous (so that it can no longer be associated with you), in which case we may use this information indefinitely without further notice to you.

“Cookies” are pieces of information that may be placed on your computer by a Site for the purpose of facilitating and enhancing your communication and interaction with that Site. We may use third parties, such as Google Analytics or other analytics providers, to analyze traffic to a Site. Google Analytics does not create individual profiles for visitors and only collects aggregate data.

The security of your Personal Information is very important to us. We use reasonable administrative, technical, and physical security measures designed to protect your information, including encryption for data transmission. However, due to the inherent nature of the Internet, no method of transmission or storage is completely secure, and we cannot guarantee absolute security. We will notify you of any data breach affecting your personal information as required by applicable law.

We have put in place reasonable physical, electronic, and managerial procedures to safeguard the information we collect. Only those employees who need access to your information in order to perform their duties are authorized to have access to your Personal Information.  If you have reason to believe that your interaction with us is no longer secure (for example, if you feel that the security of any account you might have with us has been compromised), please immediately notify us of the problem by contacting us in accordance with section 19 below.

Our Site may contain links to other websites not maintained by us. Other websites may also reference or link to our Site. The inclusion of a link on the Site, including the link to a third-party website, does not imply our endorsement of the linked site. We are not responsible for the privacy practices of websites operated by third parties that are linked to or integrated with our Site, or for the privacy practices of third-party Internet advertising companies. 9. “Do Not Track”:

Do Not Track (“DNT”) is a privacy preference that users can set in certain web browsers. DNT is a way for users to inform Sites and services that they do not want certain information about their webpage visits collected over time and across sites or online services. We do not knowingly collect or maintain information from persons under the age of 18, consistent with our enhanced protection standards for minors. If we determine upon collection that a user is under this age, we will not use or maintain their Personal Information. If we become aware that we have unknowingly collected personally identifiable information from a person under the age of 18, we will take immediate actions to delete such information from our databases, systems, and applications. If you reside in the UK, EEA or Switzerland and would like to submit a complaint about our use of your Personal Information or response to your requests regarding your Personal Information, you may contact us or submit a complaint to the data protection regulatory authority in your country. Certain US state privacy laws, including California law, afford eligible residents the right to appeal a denial of a Privacy Rights Request in whole or in part. For additional information regarding how to submit a Privacy Rights Request appeal under U.S. state privacy laws, please email privacy@faccnyc.org. We will respond to appeals within 45 days of receipt as required by California law. If we deny your appeal, California residents may contact the California Privacy Protection Agency to submit a complaint.

How to change your information on our Site:

• To change your email address, please email info@faccnyc.org
• You cannot change the email address on your account as it is how you login. To disable your account and remove your email address, email membership@faccnyc.org. Please note that under California law, you have the right to request deletion of your Personal Information, subject to certain exceptions, by submitting a verifiable consumer request to privacy@faccnyc.org.

To opt out of our email marketing campaigns:

Click the unsubscribe link at the bottom of an email from us or you can email membership@faccnyc.org You may continue to receive service-related and other non-marketing emails for which you have not opted out.

How to Reject Cookies:

• Most browsers let you remove or reject cookies. Many browsers accept cookies by default until you change your settings. To update your browser settings, follow the instructions in your browser. Please note that if you set your browser to disable cookies, the Site may not work properly.

The Site is hosted in the United States. We also retain statistical information about applicants to help with our recruitment activities. California applicants should note that the CCPA provides specific rights regarding employment-related Personal Information, and we will process such information in accordance with applicable California employment laws.
